Can I build a basement apartment and rent it out?
The short answer is – probably – but there are significant hoops to jump through.
As part of Ontario’s Housing Supply Action Plan the provincial government passed legislation to allow legal basement apartments (ADU’s Accessory Dwelling Units) across the province. However, each municipality has the right to create their own Zoning Conditions (parking requirements, apartment access from the exterior, size of the apartment, how many dwelling units are examples of these conditions) which must be met before an ADU can be registered or built.
As I prepare this note I have several open ADU projects on the go, a few of which are illegal, and the owner is being forced to renovate them. If you are purchasing a home with an ADU it would be wise to ensure that ADU was built and is Registered with the local municipality.
